1. Acceptance of Terms
By accessing or using Sentiami, a service provided by Vaivatta Digipalvelut ("we", "us", "our"), you agree to be bound by these Terms and Conditions. If you do not agree, you may not use the service.
2. Description of Service
Sentiami is a cloud-based restaurant management platform that provides point-of-sale, order management, inventory tracking, staff management, accounting, website hosting, and related services for restaurant businesses.
3. User Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate and complete information when creating an account. You agree to notify us immediately of any unauthorized use of your account.
4. Payment Terms
Fees are charged based on the contract type selected (per-order or lifetime license). All fees are non-refundable except as required by applicable law. We reserve the right to modify pricing with 30 days written notice. Outstanding invoices are due within 14 days of issue.
5. Intellectual Property
All content, features, and functionality of Sentiami are the exclusive property of Vaivatta Digipalvelut and are protected by copyright, trademark, and other intellectual property laws. Your subscription grants you a limited, non-exclusive, non-transferable license to use the service.
6. Your Data
You retain ownership of all data you enter into Sentiami. We process your data solely to provide the service and as described in our Privacy Policy. You may export your data at any time. Upon account termination, your data will be retained for 90 days before permanent deletion.
7. Termination
Either party may terminate the agreement with 30 days written notice. We may suspend or terminate your access immediately if you violate these terms. Upon termination, your right to use the service ceases, but provisions regarding intellectual property, limitation of liability, and governing law survive.
8. Limitation of Liability
To the maximum extent permitted by law, Vaivatta Digipalvelut shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue. Our total liability shall not exceed the amount paid by you in the 12 months preceding the claim.
9. Changes to Terms
We may update these terms from time to time. We will notify you of material changes via email or through the service. Continued use after changes constitutes acceptance of the updated terms.
10. Governing Law
These terms are governed by the laws of Finland. Any disputes shall be resolved in the courts of Lahti, Finland. Nothing in these terms limits your rights under mandatory consumer protection legislation.
